Introduction
In the AUP ‘you’ and ‘your’ mean the customer (that is, you!); ‘we’, ‘our’’ and ‘us’ mean SIS Group Pty Ltd trading as Planet Prepaid; and ‘service’ means the provision of Wireless Broadband or Dial-Up internet access. By using the Service the Customer agrees to be bound by the terms and conditions for their particular access technology, which should be read in conjunction with this document.
All users are expected to use good judgment. A flexible, friendly atmosphere can be maintained if the subscribers use the system with care and without abusing these conditions of service.
Conditions of Service
We reserve the right to modify and update the Terms and Conditions or AUP without notice, but when ever possible, we shall undertake to give due advice to you of such changes. Violation of any of the Terms and Conditions or AUP may lead to suspension or termination of your account without notice. We reserve the right to discontinue, without refund, or notice, any subscription or pre-paid card whose usage of the service is deemed to be an abuse of the system, and we may charge a client for any cost incurred by such abuse.
User Guidelines and Netiquette
The customer may not use, nor allow any other party to use the Service for the purpose of sending to any forum, party or person any email, message, or any other form of communication deemed by the receiver’s to be abusive, indecent, discriminatory, menacing or persistently annoying. This includes but is not limited to the sending of ‘flame’ or ‘Spam’ emails, and harassment of any other user(s) or network(s). You are expected to show consideration for the network and for the other users of the network. At all times the application of Netiquette should apply. That is politeness, tolerance towards other users and to act in accordance with others. Planet Pre-Paid reserves the right to suspend or cancel the service to the customer, if in it’s absolute discretion the account has been or is being used for offensive, illegal activities or those considered poor Netiquette or in breach of the Ten Commandments for computer ethics.
Laws
The service shall not be used by any individual or group of persons for any activities of any illegal or fraudulent nature, including activities prohibited in any country where the Customer is gaining access through connection with our network. Breaches of regulations or laws in any country or under the Australian Commonwealth Tele-Communications Act 1989 or under other applicable Australian State and Commonwealth laws are responsibility of the customer and should indemnify Us for any legal costs, demands or consequential damages caused by the customers actions. Customers shall not download or upload any material that would result in any breach of regulations or statutory laws, copyright laws or which would result in legal action under or in connection with the Copyright Act 1968. Nor should they gain access to or attempt to gain access to any network, computer or resources without consent or by deception.
Email
Mass junk email is not tolerated by the Internet community nor accepted by Us. If you engage in mass delivery of e-mail or Spamming without consent from Us, will result in a review of your subscription, potentially leading to membership account termination and will be charged at the rate of 30 cents per MB (in-bound and out-bound). By mass e-mailing or Spamming not only will you be angering lots of people (and causing us to get lots of hate mail), you will also consuming excessive bandwidth and overloading the mail system, which was not designed for mass marketing. Some exceptions are made only for business accounts and common-interest mailing list keepers, who hold a mailing list of people, seeking to be put on this list (and not by any other method). for clarification. All communication made by a Customer must be in compliance with the Spam Act 2003 and Telecommunications Act 1997.
Background Processes and System Attacks
Shell, SSH, Telnet, detached sessions or queries are not permitted on our network computers. Attempts to run such processes are not allowed. We will at our own discretion and on an as-needed basis, remove any processes that might be running where the user is attempting or logged on. This includes all detached and remote sessions that may appear, at our discretion, to affect the Network Security or other users. Our network will not tolerate unauthorised attempts to, entry or attacks, to any computer on the internet, this includes and does not limit sending or receiving UDP and ICMP packets, files, programs, data and scripts that interferes or alters normal operation on any network or computer. Under no circumstances should you retaliate if this malicious behaviour is applied to you. and we will endeavour to work in coordination with network administrators from the offending network to solve the issue. The use or attempt to use these processes, procedures and retaliation attitude will be considered system abuse and your account may be terminated without notice and without refund and you may be liable for any expenses and damages caused by the incident.
